This agreement is made between The Adventure Group (TAG) International Pty Ltd (TAG/Us/We) and the participant (You/Your).

1. Booking

1.1 By booking withTAG International Pty Ltd ACN 609 443 101 (Us/We) You accept these Terms and Conditions

1.2 Bookings will not be confirmed until the required deposit or full payment is made (dependant on the experience/adventure being booked) and notice is received by TAG via one of the following means:

• Online booking form
• Email
• Hand written booking form

1.3 By booking You consent to provide the following information:

All monies owed to include deposit, balance of the fee, any booking or administration fees payable

(a) All booking forms and associated documents

(b) Health/Medical declaration

(c) Personal particulars and Next of Kin documentation

(d) Police check* (some SOE activities require this)

1.4 You confirm that the Registration Form is complete and accurate and that You will provide us with written confirmation, as soon as possible before the Date of Departure, if any of the details provided on the Registration Form have changed.

1.5 We reserve the right to refuse your Booking Application and our decision to do so will be final and binding. Should your Booking Application be refused your full registration fee will be refunded to you.

 

2. Term

2.1 This agreement commences when you have paid a deposit or you have been issued with an invoice, whichever is the sooner.

2.2 Your booking and ends at the completion of the experience/adventure or sooner if terminated in accordance with the terms of this agreement.

 

3. Payment, Cancellation and Changes

Payment terms and conditions for TAG International experiences/adventures are detailed below.

3.1 Payment of the fee covers equipment, instruction, advice, items and activities listed in relevant Joining Instruction document.

We start to incur costs as soon as participants make a booking. Due to the nature and complexity of all our experiences/adventures these costs are significant.

3.2 The Caves (Woman, Man, Bear, Parent & Child)

(a) Full payment for the entire package is required at the time of booking in order to secure assets and venues.

(b) Cancellations or date changes must be received in writing to admin@hqtag.com

(c) Any cancellations or date changes to confirmed bookings within 60 days will forfeit 50% of the entire package.

(d) Any cancellations or date changes to confirmed bookings within 45 days will forfeit 100% of the entire package.

(e) We may terminate this Agreement by written notice to You if You fail to make any payment due to Us in accordance with the terms of this Agreement.

(f) We may terminate this agreement by written notice to You if You breach any of the terms of this agreement.

Short notice bookings are accepted where they can be accommodated without impacting quality or safety – assets and venue dependent.

3.3 The Corporate Cave and SOE

(a) A 50% deposit is required at the time of booking in order to secure Your preferred date,            assets and venues.

(b) Full payment is required 60 days from date of experience / adventure.

(c) Cancellations or dates changes must be received in writing to admin@hqtag.com

(d) Any cancellations or date changes to confirmed bookings within 60 days will forfeit 100%  

(e)  We may terminate this Agreement by written notice to You if You fail to make any payment due to Us in accordance with the terms of this Agreement.

(f) We may terminate this agreement by written notice to You if You breach any of the terms of this agreement.        

Short notice bookings (less than 60 days) are accepted where they can be accommodated without impacting quality or safety – assets and venue dependent.

3.4 Gift Certificates

Gift certificates are available for purchase for some of our experiences / adventures.

The following terms an conditions apply to the purchase and redemption of gift certificates.

(a) Valid for 12 months from date of purchase.

(b) Non-refundable and non-transferable.

(c) Cannot be redeemed for cash.

(d) Bookings are essential and subject to availability.

(e) Standard booking conditions apply for the experience / adventure booked.

(f) Standard cancellation policies apply as per the experience / adventure booked.

3.5 Changes by TAG International

(a) If there are too few participants on the experience/adventure or TAG International for any other reason has to cancel the experience/adventure, TAG International reserves the right to offer alternative experiences/adventures on other dates.

(b)The offer of alternative dates must be taken within 12 months from the date of the original booking.

 

4. Health and Medical

4.1 You agree to provide a true and accurate health/medical declaration form containing all relevant information as listed in the form.

4.2 TAG International reserve the right to refuse bookings or participation on experiences/adventures if certain pre-existing health/medical conditions exist that may increase the likelihood of illness or injury during such activities.

4.3 Failure to declare existing health/medical conditions will result in the participant being immediately removed from TAG International activities and will also result in the following:

(a) Participant to pay any and all costs and expenses associated with such a removal

(b) Loss of all deposits and monies paid for the experience

(c) Participant agrees to indemnify TAG International against any consequential costs, claims, losses and expenses arising from the removal

(d)TAG International reserves the right to withdraw participants from experiences / adventures on the advice of its medical team/advisor.

 

5. Disclaimer

5.1 TAG International reserves the right to refuse bookings from individuals or groups. This decision is final and binding.

5.2 TAG International is not responsible or liable for any breach of law in the relevant jurisdiction by a participant or the guest/associate of a participant.

5.3 Information, activities and pricing will change from time to time – at the time of issuance every effort has been made to ensure that all information provided by TAG International is accurate and free from error.

 

6. Release and Waiver

By signing the booking form, You:

(a) agree to waive any and all claims against Us, our officers, employees, agents or representatives (“Staff”);

(b) acknowledge that the Adventure is a physical challenge which involves inherent risks of injury, death, property damage or other loss; and

(c) release Us from all liability and agree not to take legal action against Us or our Staff for any personal injury, death, property damage or loss sustained during or arising in any way out of Your participation in the Adventure (even if it arises in any way out of other things or breaches of Your rights).

 

7. AUSTRALIAN CONSUMER LAW WARNING

7.1 The Australian Consumer Law implies the following guarantees into this agreement:

(a) Guarantee that services will be rendered with due care and skill; and

(b) Guarantee that the services are reasonably fit for the purposes specified by the consumer.

7.2 Section 64(2) of the Australian Consumer Law allows Us to ask You to agree that the conditions listed at 7.1 (a) and 7.1(b) do not apply to You.

7.3 By signing the booking form, You agree that Your right to take legal action against Us, and our Staff under the Australia Consumer Law for the guarantees listed at clause 7.1 is excluded, modified or restricted in the way set out in this agreement.

 

8. PRIVACY

8.1 Our privacy Policy is available on our Website.

8.2 By submitting Your Booking Application documents You agree that You have read and agree with the terms of Our Privacy Policy. By agreeing to this document You grant TAG International Pty Ltd permission to your likeness statement or videotapes of yourself resulting from your participation on your adventures in our business, corporate and/or promotional materials.

 

9. Force Majeure

9.1 If the TAG International experience/adventure is affected by a Force Majeure, not arising out of TAG’s negligence, participants agree that TAG International will not be required to pay compensation to participants. Participants will forfeit all payments made even if the Force Majeure results in the experience/adventure being partly or completely cancelled.

9.2 A Force Majeure may include, but is not limited to the following: war, riot, industrial disputes, terrorism, natural disaster, fire, epidemics and pandemics, health risks, disrupted travel points of arrival and departure (airports, seaports, land border crossings etc), CBRN (Chemical, Biological, Radiological and Nuclear) disasters or accidents, politically motivated violence and extremism, declaration of martial law or curfews, rescheduled or cancelled transportation, technical or mechanical failure, extreme weather conditions or forecast, Government travel warnings.
